I really regret filing for an IVO

I really regret filing for an IVO

So on Thursday evening I decided to file a IVO against my mum. I applied it online via our state’s magistrates court website. The application hasn’t been formally processed/assessed yet since it was during after hours, plus yesterday was a public holiday. Now, the following morning (yesterday morning) it seems that I was able to settle things with my mum after she explained so many things to me (she was saying all of these from a place of care even when I’ve expressed to her many times that I do NOT wish to be in a relationship or potentially marry someone she tries to introduce me with just because she wants me to connect with people so bad) via messenger after I kept arguing with her over it. And the things she said actually made me reconsider…and thought about withdrawing/revoking my IVO application. I thought, maybe I should actually be more open to meeting the guy that she just introduced me with via messenger on Thursday afternoon. So I applied to revoke the order online through the same website yesterday evening.

Ever since last night, I haven’t been able to get any sleep since throughout all those hours (though I took breaks in between) I kept googling for answers with several different related questions after I’ve read that you still need to attend court hearing even after you’ve applied to revoke your application. That really made me scared and broke my heart, as I’m now scared what my mums gonna think and feel about it all. But I also don’t want her to experience that much level of anxiety as much as I do… 😞

They’ll still call me and my mum about the application as well as a requirement for us to attend a court hearing in the next couple of business days unfortunately. 😭

The reason I applied for the IVO was because the situation I’ve mentioned to numerous services in the past 2-3 months they all provided this as one of the options (even if that means that my mum and I aren’t allowed to be in contact with each other ever again), so I now decided to go for it, thinking that it’ll be fine if my mum and I aren’t allowed to be in contact with each other after the application has been processed/assessed by the court… but thinking about that now I regret applying for it and would like for us to remain in contact 😞 but since I’ve applied to revoke the order, I really hope with the evidence I can provide to the magistrate to show that there really was a ‘change of circumstances’ or whatever can make them revoke/dismiss my application.

I’ve consulted with a paid lawyer though and he’s doing his best to get things sorted for me on Tuesday when the court opens again, to see if he’ll be able to get my application dismissed BEFORE the court processes the application. Praying that this’ll be the case for Tuesday 🙏🙏🙏

I’ve been severely stressed out and crying at the thought of having to go to court but also the thought of my mum and I not allowed to talk to each other as part of the requirement now really breaks my heart... But again, I really hope my lawyer will be able to get it dismissed before the court actually processes the application.🙏😭

this time I’m trying to calm down a bit after having a chat to another lawyer about it and him trying his best to reassure me and encourage me to stay positive and to wait for Tuesday

Re: I really regret filing for an IVO (update?)

so I've come to realise based from my chat history that I've had with this lawyer I started speaking to on the webchat/live chat since yesterday morning, I've figured that there was a misunderstanding.

So... looking at the previous chat I didn't initially let him know that I've already filled in the form online to revoke the application, hence why he thought that it was strange when the registrar only responded to me with "the court will cancel an application" on the email without an explanation since he thought i didn't formally request for a withdrawal/revocation. I realized that it was my mistake for not telling him earlier that I've already filled in the form for it online, so had to tell him about it this morning and it felt relieving based from what he responded after that. 😄

So in this case, it's actually great that the registrar told me that the court would cancel it, especially when the IVO I've initially applied for hasn't formally been processed by the courts yet.

So I'm relieved, now just waiting for a lawyer of mine (the one thats handling my case with the court) to get back to me and confirm on tuesday.

Re: I really regret filing for an IVO (update?)

@MissGremlin it really was! Especially when I’ve realised that I didn’t tell him about it sooner that lead me to continue having all of these intense anxiety and emotional episodes yesterday even though I was able to calm down and de-stress towards the end of the day. Gladly I was able to sleep last night though. 😊

@Blackcloud it's always the way, that we don't realise until later. Especially cos you were in such a heightened state that it would have not even crossed your mind. I'm glad you were able to sleep last night.

I hope you have a good day sweet ❤️

Re: I really regret filing for an IVO

I don't know if it differs depending on where you lodged the IVO but when I lodged one online I got a phone call from someone at the courts to help with the application. It didn't go straight to be heard. I assume this is the normal process and if so you can cancel the application then.

That's awesome to hear @Blackcloud - did you hear from you lawyer today?

Re: I really regret filing for an IVO (update?)

@Jynx I haven't. But I have sent an email to the IVO team this morning to get the confirmation from them too. Hopefully they'll be able to get to it like tomorrow or something.

But anyways, the thought of having to potentially be with someone and not remain single as long and as much as i want to is really bothering me. but i do also hope that the guy i'll meet would be a good and an understanding man...*shrug*

@Blackcloud are you musing on potential partners generally, or a particular person?
