I'm sitting here crying after receiving a phone call from my Superannuation Company. I put in a claim last year on my insurance. This was after my lawyers recieved a letter from them, saying I had cover. Oops they made a mistake. The letter was wrong. No they will not honour the letter they wrote. My claim is denied!!! We are talking about a payment of between $8,000 & $10,000 only. So since my Workplace incident back in 2014 - my ex employer - is not held responsible. Worksafe still won't release any report on my incident or the other 2 incidents that occurred in that workplace. On the 25th of this month - I get my last Workcover pay - which has really equated to 60% of my part time income prior to injury. I can't sue my employer. The laws are different for Mental Health injuries, compaired to Physical Injuries. And because I have gotten better - my percentage of incapacity has reduced & now falls below the threshold. That threshold is higher for Mental Injury compaired to a Physical Injury. So I have lost over $30,000 of income since this workplace injury. I owe thousands in back rates to the local Council. I'm behind in all my bills. I don't have a job. I'm a single parent of a teenage boy who needs clothes and shoes. God, I need clothes. Mine are falling apart. I start getting 'better' & think " I can do this. I can create a good new life". & then bang!!!! They kick me down again. It feels like everh time I try and get back up - they just keep kicking and kicking and kicking. I'm tired of being constantly kicked. I'm tired of having to constantly struggle - medically, emotionally, financially. I'm so bloody tired of having to do it all on my own. Sometimes suicide looks so tempting. To just have it all stop. To end the pain and the struggle. To hurt no more. I'm so bloody tired of fighting. One morw kickand I ddon't think I could get up again. It's just not bloody fair.
Thanks everyone @Former-Member@Appleblossom@Former-Member@Former-Member@Zoe7. Just a really frustrating day. Had a sleep for 4 hours. It's helped a little. I'm not swearing anymore. Thanks

Re: It's not bloody fair!
@Former-Member. I'm angry and feeling numb. Of that is possible.

Re: It's not bloody fair!
I think its pretty possible 😞 you have every reason to be angry, but feeling it all would be pretty much to handle, so numbness is probably looking after you for a bit!

Re: It's not bloody fair!
@utopiayes that's not only possible, it's reasonable. Take this time to breathe. not meant glibly, you're probably processing. Good time to leave it to the subconscious at this stage, might get an "aha" moment from it. Distract or snooze now. Don't think about it, if possible. Just for now.

Oh my goodness @utopia I only just read your post.
You are 100% correct - it's not bloody fair!!!!!!!!!!!!
Apologies if you stated this elsewhere, but what advice did you lawyer give you (if you're able to share).
You don't deserve this!

Re: It's not bloody fair!
Sorry to hear about all the workcover rubbish @utopia. It does all sound epically unfair and makes 100% sense for you to feel this way. Distraction/sleep does sound like the best bet for the moment while the stuff processes, so you're doing the right thing. Take it easy.

Re: It's not bloody fair!
@NikNik. To sue my employer I have to be classed as 30% permanent disability. The lawyers don't think I would have this high a percentage injury. When I rang today the new lawyer (same firm) said that I could go to the civics tribunal - if I am under the 30% injury & I can plead my case and tell them what I can no longer do & how this has affected me. I'll talk to this new lawyer on Tuesday. I need to find out if this will be covered under their no win no fee. I just can't believe how easy it is for my ex manager to sue the company for unfair dismissal - yet I'm the one who is struggling.

Re: It's not bloody fair!
Oh @utopia the decision you've received isn't bloody fair at all! I think the shock and numbness you are feeling now is very reasonable. I am so sorry this is happening for you. It's not something you deserved at all.

Thinking about you @utopia. It's not bloody fair. See what the new lawyer has to offer you. Is it worth contacting Mental health Australia and see if they can advise you? 💕💜💕
