Something’s not right

It's not bloody fair!

It's not bloody fair!

I'm sitting here crying after receiving a phone call from my Superannuation Company. I put in a claim last year on my insurance. This was after my lawyers recieved a letter from them, saying I had cover.
Oops they made a mistake. The letter was wrong. No they will not honour the letter they wrote.
My claim is denied!!!
We are talking about a payment of between $8,000 & $10,000 only.
So since my Workplace incident back in 2014 - my ex employer - is not held responsible. Worksafe still won't release any report on my incident or the other 2 incidents that occurred in that workplace.
On the 25th of this month - I get my last Workcover pay - which has really equated to 60% of my part time income prior to injury.
I can't sue my employer. The laws are different for Mental Health injuries, compaired to Physical Injuries. And because I have gotten better - my percentage of incapacity has reduced & now falls below the threshold. That threshold is higher for Mental Injury compaired to a Physical Injury.
So I have lost over $30,000 of income since this workplace injury. I owe thousands in back rates to the local Council. I'm behind in all my bills. I don't have a job. I'm a single parent of a teenage boy who needs clothes and shoes. God, I need clothes. Mine are falling apart.
I start getting 'better' & think " I can do this. I can create a good new life". & then bang!!!! They kick me down again.
It feels like everh time I try and get back up - they just keep kicking and kicking and kicking.
I'm tired of being constantly kicked. I'm tired of having to constantly struggle - medically, emotionally, financially. I'm so bloody tired of having to do it all on my own.
Sometimes suicide looks so tempting. To just have it all stop. To end the pain and the struggle. To hurt no more.
I'm so bloody tired of fighting. One morw kickand I ddon't think I could get up again.
It's just not bloody fair.

Re: It's not bloody fair!

I hear you @utopia . So.. what can you do? Can I ask what your diagnosis is? They are saying bi polar.. but it sounds to me it's a form of PTSD those two can be mistakenly assessed because of how symptoms can present. Can you perhaps change practiioners and be reassessed? I don't know your story, I'm sorry, because you arrived before me and playing catch up is hard. But the glimpse you just wrote to me .. that is what could be something to consider if you haven't already?

Re: It's not bloody fair!

@Former-Member. I am diagnosed depression and anxiety (adjustment disorder) & PTSD. The 2nd last Psychiatrist from Workcover didn't see any signs of PTSD - but I saw him after my successful EMDR therapy.
I just rang the Lawyers. I have an appointment for next Tuesday. He said I could go to the Civic Tribunal or whatever they are called & plead my case - even though I'm under 30%. I'll take my mum with me. Because I forget stuff that's said to me.
But I don't think I stand much chance with Workcovers layest psych review.
Why does everything have to be such a fight?
I've organised my mum to pick my boy up from school, grab some clothes from here and take him to soccer training. Then he'll stay at her house tonight.
I'm going to try and go to sleep. I'm tired.

Re: It's not bloody fair!

@utopia .. ok .. you need to find someone who is going to bring it back to PTSD, if possible. No sign of PTSD? really? then how come I saw a sign of it? Food for thought right there.

Re: It's not bloody fair!

Getting stuffed around by systems like this is the last thing anyone needs @utopia - especially someone who has suffered enough already. Sorry things are so hard and incredibly unfair. I hope you manage some restful sleep.

Re: It's not bloody fair!

Maybe you recognise trauma because you're not someone who stands to lose if trauma was more recognised @Former-Member? You can see it and I can see it and so many people with experiences can see it too. Thankfully it's being more recognised but I can't stand how easily the impacts of trauma can be fitted somewhere else when it's not helpful and sometimes wvwn harmful, for the person who is at the centre of it. (Hope I'm not out of line - @utopia, I'm just frustrated for you too).

Re: It's not bloody fair!

@utopia Does your phone record? I find if I go to important meeting or have important discussions like that, because of shonky memory, recording it is really helpful. Then I can make notes from the recording. Just an idea to throw out there.

yes @Former-Member it is certainly frustrating. No doubt about that one! The symptoms are frustrating enough, but when they aren't being assessed correctly, and they are being invalidated it's all magnified beyond belief. Very annoying and that feeling of helplessness and hopelessness that comes with it just exacerbates everything.

Re: It's not bloody fair!

@utopia - So sorry to read of what happened to you. It's a good idea to let yourself rest and recover from this shock. But when you do feel better my friend seek further legal advice through any means you can. Local community centres etc can offer free legal assistance and advice. I would imagine they have to honour their mistake. Don't give up. We are here for you.

Re: It's not bloody fair!

It's unbelievable @utopia, what people do (or don't do) in the name of Buisness profits, or to avoid financial losses. They put on their blinkers and refuse to see you, and their denial often works for them. It sucks. Can you get help from Centerlink, it's not much, but it's something. They have financial advisors to help with 'backed-up' bills, not to pay them, but plans and the likes.

Feeling for you

Re: It's not bloody fair!

Laws often do protect the wrong interests, which is why social justice is pretty skew whiff.

It is also a big decision to decide to carry on appeal processes.

Lots of looking after you. A bit of research into best approach.

We will be here with you, whatever you decide, and however you feel.
