I'm sitting here crying after receiving a phone call from my Superannuation Company. I put in a claim last year on my insurance. This was after my lawyers recieved a letter from them, saying I had cover. Oops they made a mistake. The letter was wrong. No they will not honour the letter they wrote. My claim is denied!!! We are talking about a payment of between $8,000 & $10,000 only. So since my Workplace incident back in 2014 - my ex employer - is not held responsible. Worksafe still won't release any report on my incident or the other 2 incidents that occurred in that workplace. On the 25th of this month - I get my last Workcover pay - which has really equated to 60% of my part time income prior to injury. I can't sue my employer. The laws are different for Mental Health injuries, compaired to Physical Injuries. And because I have gotten better - my percentage of incapacity has reduced & now falls below the threshold. That threshold is higher for Mental Injury compaired to a Physical Injury. So I have lost over $30,000 of income since this workplace injury. I owe thousands in back rates to the local Council. I'm behind in all my bills. I don't have a job. I'm a single parent of a teenage boy who needs clothes and shoes. God, I need clothes. Mine are falling apart. I start getting 'better' & think " I can do this. I can create a good new life". & then bang!!!! They kick me down again. It feels like everh time I try and get back up - they just keep kicking and kicking and kicking. I'm tired of being constantly kicked. I'm tired of having to constantly struggle - medically, emotionally, financially. I'm so bloody tired of having to do it all on my own. Sometimes suicide looks so tempting. To just have it all stop. To end the pain and the struggle. To hurt no more. I'm so bloody tired of fighting. One morw kickand I ddon't think I could get up again. It's just not bloody fair.
I totally understand - you need your own space. You are completely right - no-one deserves MI and everything that goes along with it. But what has been done to you right now is not acceptable and there has to be a way to fight this - I don't know much about the system that is doing this to you - there are certainly a lot more people on here who will have advice in that area - what I can do for you is continue to sit with you, hold your hand and listen when you need me. I am here with you my friend and I am listening if you want to talk or vent @utopia xxx

Re: It's not bloody fair!
@utopia regarding @Faith-and-Hope's question... have you explored other legal avenues? Is this appointment next week your first toe in water on that? Do you know anyone who can personally recommend a good lawyer? This is two years old ... and is talking about setting a precedent even though the case was unsuccessful. This might be an avenue to explore and research. Or bring up with the lawyer next week? I'm sorry if I am over stepping, I just really want to help you think of everrything possible to help you get this.
:face_with_rolling_eyes: at myself... might help if I post the darn link to the story! I'm and idjit!
This is why I think bring it back to PTSD if possible. Because that is what it sounds like to me so surely a good psych can see that too.

Re: It's not bloody fair!
Thanks @Phoenix_Rising. That's how I think. It is just an illness located in the brain. Just like any other illness of the body. If an illness can be 'seen' via blood tests or other methods - then it is recognised as 'real'. Mental illness is harder to 'see' & because of that, insurance companies, workplaces etc, can & do descriminate. @Zoe7. I know you are there for me. As are my other forum family members. I am okay now. I'm not as 'devastated' as I was when I first got the call from the Insurance company today. I'm going to make myself a fresh banana milkshake & play Solitaire and then go back to sleep. Sweet dreams to you all.

Re: It's not bloody fair!
@utopia, Sorry I've just court up on this thread. The one question I have is: Did you have any MH issues before all this incident happened at wok?
If not this is the main thing the lawyers need to consentrate on to fight your case. If all your MH was brought on because of the incident you had, then it would be clear that it is work related. The Workcover phycs are A holes and will do everything for workcover and not the client.
Hugs to you.

Re: It's not bloody fair!
@Heart. I had depression prior to working with this company. I was on the lowest dose of an AD & hadn't had any depressive thoughts for at least 5 years. My workplace knew I had depression. @Zoe7. Anyway I let out my big angry, frustrated rant yesterday. Today I can just put it to the side (except for research). So I'm feeling good today. Thank you to everyone who responded to my thread. It's always a comfort to know that my feelings are 'reasonable' amd that I am supported here. Really truly appreciate that. Well I'm off to do the grocery shopping & to buy a tattslotto ticket - you have to be in it, to win it. Lol

@utopia Just popping in to say I hope your meeting with the lawyer is super productive and you get some options ironed out. Best of luck with it, hope the lawyer is a good one.
