actual torture occurring in Australia

actual torture occurring in Australia

s 274.2 of Commonwealth Criminal Code sets out the offence of torture, which can be summarised as:

  1. conduct inflicting severe physical or mental pain or suffering
  2. for the purpose of obtaining information, punishing, intimidating or coercing
  3. by or at the instigation of a public official

(the full definition is at the bottom of this post)

I have information that the police would like me to give them and that information is incriminating, so I have a bedrock legal right not to give it

I think it's fair to say that relentless bullying and psychological abuse along with gaslighting over many years ("you're not being mistreated, it's all in your head") would satisfy the "severe mental pain or suffering" part

if the reason is to coerce me to "come clean", or "not talk", or "move on" or anything else, then we have the second part

and if the conduct can be connected back to the police or any other public official, then we have a slam dunk

this is how torture occurs in this country

Criminal Code s.274.2:

(1) A person (the perpetrator) commits an offence if the perpetrator:

(a) engages in conduct that inflicts severe physical or mental pain or suffering on a person (the victim); and

(b) the conduct is engaged in:

(i) for the purpose of obtaining from the victim or from a third person information or a confession; or

(ii) for the purpose of punishing the victim for an act which the victim or a third person has committed or is suspected of having committed; or

(iii) for the purpose of intimidating or coercing the victim or a third person; or

(iv) for a purpose related to a purpose mentioned in subparagraph (i), (ii) or (iii); and

(c) the perpetrator engages in the conduct:

(i) in the capacity of a public official; or

(ii) acting in an official capacity; or

(iii) acting at the instigation, or with the consent or acquiescence, of a public official or other person acting in an official capacity.

Re: actual torture occurring in Australia

this happened today

I got an email from my lawyer falsely alleging that I made "inappropriate comments" to colleagues and threatening to withdraw service if such "conduct" continued

but my lawyers have been largely unresponsive and delaying as well as very obviously over-charging

so we are now firmly in the realm of lawyer misconduct and blatantly false allegations

the bullying is steadily increasing

Oh yuck @f0x that's so crappy. Almost sounds like projection, like they've dropped the ball and then wanna use you as the scape goat. I mean were they better before or is this bullying a recent development?

Re: actual torture occurring in Australia

I've had consistent difficulty with lawyers but this level of manifest misconduct is new

yes I'm clearly being scapegoated by some very corrupt people

which is fine, the more it happens, the bigger a hole they dig

Re: actual torture occurring in Australia

as for bullying generally, I've been getting bullied consistently from all quarters for over a year

it's almost like the idiot in charge doesn't realise that the more they push me, the firmer my resolve becomes

they could just stop doing this at any point, but they just keep pushing and pushing

Re: actual torture occurring in Australia

@f0x sounds incredibly unprofessional. You strike me as a smart cookie so I'm guessing you've been keeping a paper trail of their crappy behaviour? Is it a situation where you could have legal leverage to sue for misconduct or something?

Re: actual torture occurring in Australia

Also @f0x my knowledge of legal stuff is rudimentary at best so if none of this is helpful feel free to let me know 😅

@Jynx

yeah I try to get everything in writing and I'll report it when the time comes

but I've already complained about previous lawyers to the legal services commissioner who, predictably, buried it

how do I access the legal system if the cops are determined to compromise my lawyers? the answer is I can't, and that's blatant corruption

the more this continues, the more material there will be to submit to the ICAC

but in a plot twist no one will see coming, the ICAC will probably say "nothing to see here" because it turns out that the purpose of "independent" oversight bodies is to protect those they oversee from inconvenient attention

Re: actual torture occurring in Australia

I've already made a complaint about the police but that was closed without investigation

I have contacted the justice portfolio holder of my political party explaining the situation in detail but despite the clear and flagrant misconduct, abuse of power and corruption, their office inexplicably declined to assist

(I've also been bullied by party members in a chat room restricted to this party)

I mean, if the goal is to make me believe "everyone is out to get me" then conspicuously failing to assist in matters of misconduct and corruption would go a long way to doing that, wouldn't it?

the preferred way for corrupt bureaucrats to cover up misconduct is to make out that the person making the allegation is paranoid

it makes you wonder though, just how far will the system go to make me the scapegoat?

(thanks @Ru-bee for explaining the guidelines)

Re: actual torture occurring in Australia

@Jynx, anyone?

clearly I'm just going to get bullied everywhere until some objective is achieved

but I can't comply with a demand if I don't know what the demand is

I guess the objective then is for me to kms because this isn't going to end any other way

This sounds like their behaviour is really scary @f0x , and confusing if you're not sure what they're demanding of you.

How have you been managing this so far, I hear it's been really hard of course, but what are somethings that have been helping you through this time?
