Something’s not right

It's not bloody fair!

It's not bloody fair!

I'm sitting here crying after receiving a phone call from my Superannuation Company. I put in a claim last year on my insurance. This was after my lawyers recieved a letter from them, saying I had cover.
Oops they made a mistake. The letter was wrong. No they will not honour the letter they wrote.
My claim is denied!!!
We are talking about a payment of between $8,000 & $10,000 only.
So since my Workplace incident back in 2014 - my ex employer - is not held responsible. Worksafe still won't release any report on my incident or the other 2 incidents that occurred in that workplace.
On the 25th of this month - I get my last Workcover pay - which has really equated to 60% of my part time income prior to injury.
I can't sue my employer. The laws are different for Mental Health injuries, compaired to Physical Injuries. And because I have gotten better - my percentage of incapacity has reduced & now falls below the threshold. That threshold is higher for Mental Injury compaired to a Physical Injury.
So I have lost over $30,000 of income since this workplace injury. I owe thousands in back rates to the local Council. I'm behind in all my bills. I don't have a job. I'm a single parent of a teenage boy who needs clothes and shoes. God, I need clothes. Mine are falling apart.
I start getting 'better' & think " I can do this. I can create a good new life". & then bang!!!! They kick me down again.
It feels like everh time I try and get back up - they just keep kicking and kicking and kicking.
I'm tired of being constantly kicked. I'm tired of having to constantly struggle - medically, emotionally, financially. I'm so bloody tired of having to do it all on my own.
Sometimes suicide looks so tempting. To just have it all stop. To end the pain and the struggle. To hurt no more.
I'm so bloody tired of fighting. One morw kickand I ddon't think I could get up again.
It's just not bloody fair.

Oh no @utopia😞 that Is awful... The legalities of everything are always against us as it's the way the laws are written... To prptect the wrong interests...
Is there any way of appealing?
Here with you,

@Former-Member @maxarita. I'm just going to go to sleep. If I don't sleep through this mood it will just consume me.

@utopia, I think that's a brilliant idea. You probably need to recover your nerves after the shock. Take it easy and hope you have a restful, healing sleep.

Re: It's not bloody fair!

@utopia... wt..... you can't sue because it is psychological not physical???? wtf... that's BS. Can you write to someone? I mean there is this huge "push" to understand MH issues but the law doesn't even recognise them yet? Get mad.. get even... this is BS and write to someone, write to everyone! This need changed or at least brought to public awareness. Ok I'm really mad about this.. Can you tell??

Re: It's not bloody fair!

I can't sleep. Too worked up.
Yes @Former-Member - I can't sue. A staff member who was out on Workcover - psychological injury - can sue - because hers is a case of bullying.
My Manager at the time - can sue - for unfair dismissal. She was the manager of both of us who are on Workcover.
My Manager's Manager has since been demoted right down the line to a standard mental health worker.
But me - no I can't sue - because my injury percentage is not over 30% incapacity. It is onthe psychological scale - but not on tthe legal/medical scale used by the court system.
And now the latest Workcover Psych wrote a new diagnosis for me - Bipolar II & claims I had this before my workplace incident.
This is cow poo. I am not Bipolar. None of my mental health support team think I am. None of the previous Workcover Psych reviews think I am.
But Workcover seems to use this particular psychiatrist - when clients are near the end of their 2 & 1/2 years of Workcover pay. As this is when clients get ready to sue. And this so called doctor is called into court to discredit the client. And quite often he wins.
I have been fighting and fighting this the whole time. Who else do i fight? I haven't won anything. There hasn't even been a bloody apology from my old work place.
To them I was just a nuisance. They have done so much to discredit me. Amd there staff have told me how lucky I am and how grateful I should be - that they have still paid me every fortnight. This is their attitude. That I should be grateful that my work place - a health care network - in the mental health field - not only put me under huge stress for 18 months - & then didn't protect me from a very dangerous client - even after I went and asked my manager & her manager to please come out and help me with this person. And they said no!
I was bloody Admin! Not a psych nurse or a psychologist. I did the meet and greet and the appointments and their paperwork and created their paper and computer files. I organised the company cars for repairs services. I printed out information sheets for clients and their families. I orientated the new staff to our paperwork, policies, where the bloody toilets were. I was not a Psych Health trained staff member. I was bloody Admin.
And this guy wasn't even a client of ours. He was too sick and dangerous for our Community Mental Health set up. He was and still is a danger.
And I have no recourse. I cannot be who I used to be. I cannot work where I used to work. I can't do the same job.
I'm still suffering. My son is still suffering. And they all get to move on.
It's not bloody fair. It's not bloody fair.
IT'S NOT BLOODY FAIR!!!!

Re: It's not bloody fair!

I want to frigging scream. I want management to physically feel what I've been feeling all this time. I really want to hurt them. I want revenge. And I want the whole crappy system to stop s***ing on me - every bloody chance they get.

Re: It's not bloody fair!

@utopia It's not bloody fair at all !!!!

Scream as much as you need - laugh, cry, hit some pillows - you deserve to be heard, treated with respect and compensated for what they have put you through - and you continue to suffer - WTF - THEY were negligent and you cop all this - that is BULLSH*T!!!!

I need to go and get ready for my appointment but I am thinking of you and will be here for you when I return if you need/want me to be.

LOOOOOOOOOOOVE YOU

Zoe
